Terms & Conditions

To continue with the physical fitness and weight loss challenge (the "Challenge"), you must agree to the following health release and accept all the following terms and conditions.

You warrant and represent that you are at least eighteen (18) years of age and are in good physical, mental, and emotional health to undertake this challenge.

You warrant that you do not suffer from any condition which may impair your ability to accept or understand this health release or any of its terms and conditions.

You warrant and represent that you do not suffer from any condition or disability which could make your participation in the physical fitness and weight loss challenge (the "Challenge") dangerous to your health, to yourself or to others.

You are hereby informed, fully understand, and acknowledge that the Challenge publishers, authors, & organizers are not doctors, nutritionists, trainers, or otherwise healthcare experts, are not licensed to provide any medical or healthcare advice, and any information you receive as part of the Challenge, including, without limitation, information related to exercise, training, nutrition, or weight loss is intended to be used for informational purposes only. You agree to use this information in your sole discretion and at your own risk.

You agree that any information you receive as part of the Challenge is not medical or expert healthcare advice, and you acknowledge and agree that you should consult with your own physician, nutritionist, health care provider, and/or personal trainer before using any information, especially if you take any medications, suffer or are being treated for any illness or condition, or have any other health-related risk factors.

Your continued participation in the Challenge indicates that you have received consent from your physician to participate in the Challenge. You agree not participate or continue in the Challenge if your physician or health care provider does not approve or advises against it.

You acknowledge and fully understand that, as a direct and/or indirect result of your participation in the Challenge, you face a risk of serious physical injury, physical disability and/or death.

You agree to stop your participation in the Challenge and to seek immediate medical help and advice if you experience faintness, dizziness, pain or shortness of breath at any time while participating in the Challenge.

You hereby agree and acknowledge that your decision to participate in or otherwise use any part of the information presented during the Challenge is entirely at your own risk. If you engage in any exercise activity, you agree that you do so at your own risk, with full and complete knowledge of the risks, dangers, and hazards involved, and that you are voluntarily participating in these activities.

You understand and acknowledge any results you may obtain from your participation in the Challenge may vary and that the Challenge organizers make no promises, claims, or guarantees regarding the results you will experience.

You hereby agree to assume and accept any and all risks of any nature including, without limitation, personal injury, physical disability, illness, aggravation of an existing medical condition, and/or death, and will release and hold the publishers, authors, and Effexis Software (and its officers, directors, employees, or sponsors) (collectively, the “Releasees”) harmless from any and all claims, liabilities, damages, costs, expenses or obligations of any type for any injuries, disabilities or death that you may sustain as a result of your participation in the Challenge.

You hereby agree, for yourself and for anyone else who might make a claim on your behalf, not to make any claim against any of the Releasees for any death, illness or injury you may sustain, whether or not it is caused by the negligence of the Releasees.

You hereby verify and agree that you have read this Health Release, Liability Waiver and Terms & Conditions for participating in the Challenge, understand its terms, and that you are accepting it voluntarily without any assurance, guarantee, or inducement.

You hereby agree to each of the above terms, conditions, representations, and statements and acknowledge that they represent an unconditional and complete release of all liability (to the maximum extent allowed by law.)

If you do not agree to any of these terms, you may not participate in the Challenge and are restricted from continuing to visit and use this part of the website.
